Council Votes To Keep New Pseudoephedrine Law |

Following a hour-long discussion in closed session Monday night, the Washington, Missouri City Council voted 5-2 against repealing an ordinance which limits the sale of ephedrine and pseudoephedrine-containing products in the City of Washington. Voting against the ordinance were Meyer, Buddemeyer, Groff, Mohesky and Midkiff. Voting for repealing the ordinance were Witt and Rhodes. Had it been approved by the Council, Monday night's ordinance would have repealed the previous ordinance, passed July 6, which prohibits the sale of products containing ephedrine and pseudoephedrine without a valid prescription written by a Missouri licensed physician and filled by a Missouri licensed pharmacist. But since the Council didn't repeal the ordinance Monday night, it appears the City of Washington may become the subject of a lawsuit. Following the passage of the original ordinance, the City received a letter from the ACLU of Eastern Missouri. In that letter, the ACLU requested the City to "take immediate action to cause the repeal of the ordinance regulating OTC medication" and warned "While we would like to avoid engaging in litigation with your City, we take this matter very seriously and will explore all available options".The next steps, if any, will likely come from the ACLU.
